The POSH Act holds the employer responsible for ensuring the safety of all employees. To ensure safety of women within workplaces, the POSH Act makes it mandatory for the employer of an organization or a company to do the following:
The Sexual Harassment (Prevention, Prohibition and Redressal) Act, 2013 (POSH Act) requires companies with more than 10 employees to submit an annual report on sexual harassment. The report must be submitted to the employer and the District Officer by the Internal Complaints Committee (IC) at the end of each calendar year. The report should include the following information:
• The number of sexual harassment complaints filed in the year
• The number of complaints that were disposed of
• The number of complaints that are still pending after 90 days
• The actions taken by the employer in response to the complaints
• The number of awareness programs or workshops conducted by the employer to educate employees about the POSH Act
The POSH Act is a mandatory legal requirement, and companies that fail to comply may face penalties.
